Expert Terms

The terms for professionals offering services, programs, and content through ENFIITY. They exist to protect your clients, your practice, and the Platform — read them before applying or going live.

1Who these terms are for

These Expert Terms ("Terms") govern your participation as a professional ("Expert", "you") offering services, programs, and content through the ENFIITY platform ("Platform"), operated by ENFIITY Ltd ("ENFIITY", "we"). They apply in addition to the general Terms of Service and Privacy Policy.

By applying to join the expert network, activating an expert profile, or accepting a booking or program enrollment through the Platform, you agree to these Terms.

2You are an independent professional

You are an independent contractor, not an employee, agent, partner, or joint venturer of ENFIITY. Nothing in these Terms creates an employment or agency relationship.

  • You decide your own services, prices, programs, availability, and methods.
  • You are solely responsible for your own taxes, registrations, and business obligations in your jurisdiction.
  • You may work with clients outside the Platform; clients you bring to the Platform remain your clients.
ENFIITY is a technology platform and marketplace that connects members with independent professionals. ENFIITY does not supervise, direct, or control the professional services you provide, and is not a party to the professional relationship between you and your clients.

3Professional responsibility, qualifications and insurance

You represent and warrant, on an ongoing basis, that:

  • All qualifications, certifications, credentials, and experience you submit are true, current, and yours;
  • You hold (and will maintain) any licence, registration, or certification legally required to provide your services in the jurisdictions where you and your clients are located;
  • You carry appropriate professional indemnity / liability insurance covering the services you provide through the Platform;
  • You will practice within the limits of your competence, and refer clients to appropriately qualified professionals (including emergency services) when a matter is outside your scope.

ENFIITY's verification (including AI-assisted screening of applications and content) is a quality filter, not a professional endorsement. It does not certify your qualifications and does not transfer any professional responsibility to ENFIITY.

4Health boundaries — no medical claims

The Platform serves a general wellbeing audience. Unless you are a licensed medical professional operating within your licence, you must not, through the Platform:

  • Diagnose, treat, or claim to cure any disease or medical condition;
  • Advise clients to change or stop prescribed medication;
  • Present coaching or lifestyle guidance as medical advice.

You must advise clients to consult a qualified physician before acting on guidance that could affect a medical condition, pregnancy, or medication. If a client presents an emergency or crisis, direct them to local emergency services immediately.

Content you publish (insights, reels, programs) passes an editorial gate and may be rejected or removed if it makes unsafe or unsubstantiated claims. ENFIITY may suspend profiles pending review.

5Client data and confidentiality

Members explicitly control whether you can see their activity data (training, engagement, wellbeing). Where a member grants consent, you receive that data solely to serve that client and under these obligations:

  • Keep client data confidential; never sell it, share it, or use it for any other purpose;
  • Do not export, scrape, or store Platform client data outside the Platform beyond what is necessary to deliver your services;
  • Comply with applicable data-protection law (including UK GDPR) as an independent controller of any data you take off-Platform;
  • Delete a client's data on their request, and honour any consent withdrawal immediately (the Platform enforces this automatically for in-Platform data).

Members' private journals are never shared with you under any circumstances.

6Fees, payouts and taxes

You set your own price for each service and program ("Expert Price"). Members pay the Expert Price plus a 20% platform fee. Your revenue share is the Expert Price.

  • Payments are processed by Stripe. With Stripe Connect enabled, your share transfers automatically to your connected account per Stripe's payout schedule;
  • Expert subscription plans (Foundation/Growth/Elite) are billed separately and are non-refundable except as required by law;
  • You are solely responsible for reporting and paying your own taxes on amounts you earn;
  • Where a member receives a refund (e.g. a service not delivered), the corresponding expert share may be reversed.

7Bookings, cancellations and no-shows

You may set your own cancellation policy on your profile. Where you have not set one, the Platform default applies:

  • Either party may cancel a session at least 24 hours before the start time without charge;
  • If a member fails to attend ("no-show") without cancelling, the session is chargeable and no refund is due, unless you choose otherwise;
  • If you fail to attend, the member receives a full refund and repeated failures may lead to removal from the Platform;
  • Sessions must be marked completed or no-show honestly; disputes are resolved on the Platform's records.

8Content licence

You retain ownership of the content you create (intro reel, insights, program outlines, profile copy). You grant ENFIITY a worldwide, non-exclusive, royalty-free licence to host, display, distribute, and promote that content on the Platform and in ENFIITY marketing (with attribution), for as long as your profile is active plus a reasonable wind-down period.

You warrant your content is your own work (or properly licensed), does not infringe any third-party rights, and complies with the health boundaries above.

9Indemnity and liability

You agree to indemnify and hold harmless ENFIITY, its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • The professional services you provide (or fail to provide) to any client;
  • Your breach of these Terms, applicable law, or professional standards;
  • Content you publish through the Platform;
  • Misrepresentation of your qualifications or credentials.

To the maximum extent permitted by law, ENFIITY's total liability to you under these Terms is limited to the platform fees ENFIITY retained from your transactions in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law.

10Suspension, removal and changes

ENFIITY may suspend or remove your profile for breach of these Terms, credible complaints, safety concerns, or legal requirement — with notice where practicable. You may deactivate your profile at any time; obligations already accrued (deliver paid sessions or refund, confidentiality, indemnity, content licence wind-down) survive.

We may update these Terms; material changes will be notified through the expert portal or by email at least 14 days before they take effect. Continued use after that constitutes acceptance.

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory local law provides otherwise.
