Welcome to ENFIITY. These Terms of Service ("Terms") govern your access to and use of the ENFIITY platform, including our website, applications, AI coaching services, expert marketplace, and all related features (collectively, the "Platform"). Please read these Terms carefully before using ENFIITY. By accessing or using the Platform, you agree to be bound by these Terms.
By creating an account, accessing, or using any part of the ENFIITY platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, along with our Privacy Policy, which is incorporated by reference.
If you do not agree to these Terms, you must not access or use the Platform. Your continued use of the Platform after any changes to these Terms constitutes your acceptance of those changes.
You must be at least 18 years of age to use the Platform. By using ENFIITY, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

ENFIITY is a technology platform and marketplace. We are not a healthcare provider, medical practice, or licensed professional services firm. The Platform is designed to complement, not replace, professional medical or psychological care.
To access the full features of ENFIITY, you must create an account. Account registration is facilitated through Wix OAuth authentication. You agree to provide accurate and complete information during registration and to keep your account information up to date.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify ENFIITY of any unauthorised use of your account or any other breach of security.
Each individual may maintain only one ENFIITY account. Creating multiple accounts to circumvent Platform limitations, abuse free tiers, or evade suspensions is strictly prohibited and may result in the termination of all associated accounts.
ENFIITY reserves the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or otherwise conducted yourself in a manner that could harm the Platform, other users, or experts.
ENFIITY offers the following membership tiers:

All paid subscriptions are billed through Stripe, our third-party payment processor. By subscribing to a paid plan, you authorise ENFIITY to charge your designated payment method on a recurring monthly basis. All prices are quoted in British Pounds (GBP) unless otherwise stated.
Paid subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged the then-current subscription rate at the time of renewal. ENFIITY reserves the right to adjust subscription pricing with at least 30 days' prior notice.
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to your paid features until the end of your current billing period. After your billing period expires, your account will revert to the Explorer (free) tier.
No refunds are issued for partial months or unused portions of a subscription period. By subscribing, you acknowledge and agree to this policy. If you believe you have been charged in error, please contact us at dilshan@enfiity.com within 14 days of the charge.
Experts listed on the ENFIITY platform are independent contractors and are not employees, agents, or representatives of ENFIITY. The relationship between users and experts is a direct, independent professional relationship. ENFIITY serves solely as a platform to facilitate connections between users and experts.
ENFIITY charges a 20% platform fee on expert session prices. This fee is added to the expert's listed price and is paid by the user at the time of booking. The platform fee covers access to the ENFIITY marketplace, payment processing, scheduling infrastructure, and platform support.
Experts set their own session prices, schedules, availability windows, and service methods independently. ENFIITY does not control or dictate expert pricing, session content, or professional methodologies.
ENFIITY does not guarantee the quality, accuracy, safety, or effectiveness of any expert's services, advice, or recommendations. ENFIITY does not guarantee expert availability, responsiveness, or any specific outcomes from expert sessions. Users engage with experts at their own discretion and risk.
Expert applications are reviewed through a combination of our AI assessment system (ECLIPSE) and manual review by the ENFIITY admin team. While we take reasonable steps to verify expert credentials, ENFIITY does not independently verify every claim made by an expert and cannot guarantee the accuracy or completeness of any expert's profile, qualifications, or credentials. Users are encouraged to conduct their own due diligence before engaging with any expert.
Experts are required to maintain accurate, truthful, and up-to-date profiles on the Platform. Any misrepresentation of qualifications, experience, certifications, or credentials by an expert is a serious violation of these Terms and may result in immediate removal from the Platform.
The following terms apply specifically to individuals who register and operate as experts on the ENFIITY platform.
Experts must provide truthful and verifiable qualifications, credentials, certifications, and professional experience. Misrepresenting your qualifications is grounds for immediate and permanent removal from the Platform, and ENFIITY reserves the right to pursue legal action where appropriate.
Experts must maintain professional conduct at all times when interacting with users, both on and off the Platform in relation to services arranged through ENFIITY. This includes maintaining appropriate professional boundaries, delivering services as described, and adhering to applicable professional standards and codes of ethics.
Experts set their own session prices. The price displayed to users includes a 20% platform markup applied by ENFIITY. For example, if an expert sets their session price at £100, the user will pay £120. The expert receives their set price minus any applicable payment processing fees.
Expert payments are processed via Stripe. After the 20% platform fee deduction and any applicable payment processing fees, the remaining balance is transferred to the expert's designated Stripe account in accordance with Stripe's standard payout schedule.
Experts may subscribe to enhanced visibility and features on the Platform:

By publishing content on the Platform -- including but not limited to expert insights, articles, bios, profile descriptions, and session descriptions -- experts grant ENFIITY a non-exclusive, worldwide, royalty-free, perpetual licence to display, reproduce, distribute, and use such content for Platform operation, marketing, and the training and improvement of ENFIITY's AI systems.
ENFIITY may remove experts from the Platform at any time for policy violations, professional misconduct, sustained poor user feedback, inactivity, or any other reason at ENFIITY's sole discretion. ENFIITY will make reasonable efforts to provide notice before removal, except in cases of serious misconduct where immediate removal is warranted.
ZETA AI is NOT a medical professional, therapist, psychologist, nutritionist, personal trainer, or any other licensed practitioner. ZETA is an artificial intelligence system and all of its outputs should be treated as informational suggestions only.
All recommendations, suggestions, guidance, and content provided by ZETA AI are for general informational and educational purposes only. Nothing provided by ZETA AI should be construed as medical advice, psychological diagnosis, nutritional prescription, or any form of professional clinical guidance.
Users should always consult qualified, licensed professionals for medical, psychological, nutritional, or fitness-related advice before making decisions that could affect their health or wellbeing. If you are experiencing a medical or psychological emergency, contact your local emergency services immediately. Do not rely on ZETA AI for emergency guidance.
AI systems, including ZETA, may produce inaccurate, incomplete, or misleading information. Users are responsible for verifying any important information provided by ZETA AI before acting on it. ENFIITY does not warrant the accuracy, reliability, or completeness of any AI-generated content.
ECLIPSE is ENFIITY's AI system for reviewing and assessing expert applications. ECLIPSE assessments are automated evaluations and do not constitute professional endorsements, certifications, or guarantees of any expert's competence, qualifications, or suitability. All ECLIPSE assessments are subject to human review by the ENFIITY admin team.
ENFIITY's AI systems are continuously updated and improved. The behaviour, recommendations, and outputs of ZETA and ECLIPSE may change over time as models are updated. ENFIITY reserves the right to modify, retrain, or replace its AI systems at any time without prior notice.
ENFIITY, ZETA, ECLIPSE, and all associated logos, brand elements, and product names are trademarks of ENFIITY. You may not use these trademarks without the prior written permission of ENFIITY, except as reasonably necessary to refer to the Platform in a descriptive, non-misleading manner.
The Platform's source code, design, user interface, visual elements, algorithms, AI models, documentation, and all other proprietary content are the exclusive property of ENFIITY and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works from any part of the Platform without express written permission.
Users retain ownership of content they create and submit to the Platform. However, by submitting content to ENFIITY, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content in connection with the operation and promotion of the Platform.
Expert insights, articles, and other professional content published on the Platform are licensed to ENFIITY for display on the Platform, use in marketing materials, and for training and improving ENFIITY's AI systems. Experts retain underlying intellectual property rights to their original work but acknowledge and agree to this licence as a condition of using the Platform.
You agree not to engage in any of the following prohibited activities when using the Platform:
Bookings made through the ENFIITY platform constitute agreements between the user and the expert. ENFIITY facilitates the booking process by providing scheduling, payment processing, and communication tools, but ENFIITY is not a party to the session itself and does not control or supervise the content, quality, or delivery of any expert session.
All session payments are processed through Stripe at the time of booking. The total amount charged to the user includes the expert's session price plus the 20% ENFIITY platform fee.
Individual experts may set their own cancellation and rescheduling policies. It is the user's responsibility to review and understand an expert's cancellation policy before booking a session. ENFIITY is not responsible for any disputes arising from cancellations or rescheduling.
Some experts may offer free initial consultation sessions. These consultations are subject to the expert's individual availability and are offered at the expert's sole discretion. ENFIITY does not guarantee the availability of free consultations from any expert.
In the event of a dispute between a user and an expert regarding a session, ENFIITY may, at its sole discretion, assist in mediating the dispute. However, ENFIITY is not obligated to resolve any disputes between users and experts and accepts no liability for the outcome of any session or dispute.
The ENFIITY platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. ENFIITY expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
ENFIITY is not liable for any advice, recommendations, treatment, or outcomes provided by any expert on the Platform. Users engage with experts at their own risk and should exercise their own judgement when following expert advice.
ENFIITY is not liable for any actions taken or decisions made based on AI recommendations, suggestions, or outputs from ZETA, ECLIPSE, or any other AI system on the Platform.
ENFIITY is not liable for any service interruptions, downtime, data loss, or performance issues, whether caused by technical failures, maintenance, updates, third-party service outages, or any other reason.
In no event shall ENFIITY's total aggregate liability to you for all claims arising from or related to these Terms or your use of the Platform exceed the total amount of fees you have paid to ENFIITY in the twelve (12) months immediately preceding the event giving rise to the claim.
To the maximum extent permitted by applicable law, ENFIITY shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of profits, revenue, goodwill, data, or other intangible losses, regardless of whether ENFIITY has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless ENFIITY, its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with: your use of the Platform; your violation of these Terms; your violation of any rights of any third party; or any content you submit, post, or transmit through the Platform.
Experts additionally agree to indemnify, defend, and hold harmless ENFIITY from and against any and all claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with: the services they provide to users; any advice, recommendations, or treatment they give; any misrepresentation of their qualifications or credentials; or any breach of applicable professional standards, regulations, or laws.
ENFIITY reserves the right to modify, update, suspend, or discontinue any feature, service, or functionality of the Platform at any time, with or without notice. This includes the right to add or remove features, change AI models, modify the user interface, and alter the expert marketplace functionality.
ENFIITY reserves the right to modify subscription pricing, platform fees, and any other charges. We will provide at least 30 days' advance notice of any pricing changes to existing subscribers. Continued use of a paid subscription after a price change takes effect constitutes your acceptance of the new pricing.
ENFIITY reserves the right to review, remove, or restrict access to any content on the Platform that we determine, in our sole discretion, violates these Terms, is harmful, offensive, inaccurate, or otherwise objectionable.
ENFIITY reserves the right to collect, use, and analyse aggregated, anonymised, and de-identified data derived from Platform usage for the purposes of improving the Platform, training AI models, conducting research, generating analytics, and enhancing our services. This data will not identify you personally.
ENFIITY reserves the right to update, retrain, modify, or replace its AI models and recommendation algorithms at any time. These updates may change how the AI responds, what it recommends, or how it processes information. ENFIITY is not required to provide advance notice of AI model changes.
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
In the event of any dispute arising from these Terms or your use of the Platform, you agree to first attempt to resolve the dispute informally by contacting ENFIITY at dilshan@enfiity.com. We will make good faith efforts to resolve any dispute through direct negotiation within 30 days.
If a dispute cannot be resolved through informal negotiation within 30 days, either party may refer the dispute to mediation administered by a mutually agreed mediator. The costs of mediation shall be shared equally between the parties unless the mediator directs otherwise.
If mediation is unsuccessful, the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in class actions or class-wide arbitration against ENFIITY.
You may delete your ENFIITY account at any time through your account settings or by contacting us at dilshan@enfiity.com. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy. Please note that some information may be retained as required by law or for legitimate business purposes.
ENFIITY may terminate or suspend your account at any time for any reason, including but not limited to: violation of these Terms; fraudulent or illegal activity; sustained policy violations; non-payment of fees; or conduct that is harmful to other users, experts, or the Platform.
If an expert is removed from the Platform, such removal does not entitle the expert to a refund of any subscription fees already paid. Any pending payouts for completed sessions will be processed according to the standard payout schedule, subject to any applicable holds or investigations.
Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: intellectual property rights, limitation of liability, indemnification, and dispute resolution.
ENFIITY reserves the right to modify these Terms at any time. For material changes, we will provide at least 30 days' advance notice through one or more of the following methods: email notification, prominent notice on the Platform, or in-app notification.
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Platform and, if applicable, cancel your subscription before the changes take effect.
We encourage you to periodically review these Terms to stay informed about any updates. The "Last updated" date at the top of this page indicates when these Terms were most recently revised.
