These Terms of Service ("Terms") govern your use of the ENFIITY platform. Please read them carefully before creating an account or using our services.

By creating an account or using ENFIITY, you agree to these Terms and our Privacy Policy.

1Acceptance of Terms

By creating an account, accessing, or using any part of the ENFIITY platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Platform. Your continued use after any changes constitutes acceptance of those changes.

You must be at least 18 years of age to use the Platform. By using ENFIITY, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2Platform Description

ENFIITY is a Human Evolution OS — a personal intelligence platform designed to help individuals improve across three core domains:

  • Mental — psychological wellbeing, mindset, cognitive performance, and emotional resilience
  • Physical — fitness, movement, strength, body composition, and physical capability
  • Biological — nutrition, sleep, hormonal health, and physiological performance

The Platform provides:

  • ZETA — an AI intelligence layer for personalised guidance, pattern recognition, and contextual coaching
  • Expert Network — a curated directory of verified professionals (therapists, coaches, nutritionists, doctors)
  • Identity System — behavioural identity mapping and progression tracking
  • Workout, Nutrition, and Habit AI — tools for tracking, analysing, and improving daily behaviours
  • Shadow Self — a behavioural accountability mechanic
  • Progression Layer — a rank-based engagement system
ENFIITY is a technology platform and marketplace. We are not a healthcare provider, medical practice, or licensed professional services firm. The Platform is designed to complement, not replace, professional medical, psychological, nutritional, or fitness care.

3User Accounts

3.1 Registration

To access full features, you must create an account. You agree to provide accurate and complete information during registration and to keep your information up to date.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at team@enfiity.com of any unauthorised use.

3.3 One Account Per Person

Each individual may maintain only one account. Creating multiple accounts to circumvent limitations or evade suspensions is prohibited.

3.4 Account Suspension and Termination

ENFIITY reserves the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms or engaged in fraudulent or harmful activity.

4Membership Tiers, Trial, and Billing

4.1 Free Trial

When you sign up for ENFIITY, you receive a 7-day free trial of Pro. The trial does not require a credit card. During the trial:

  • You receive full access to Pro features
  • You receive 30 ZETA sessions for the trial period
  • You can cancel at any time with no charge

When the trial ends, you must subscribe to a paid plan to continue using ZETA. You will not be automatically charged. Your data and account remain accessible — you simply won't be able to interact with ZETA beyond a limited 3 messages per day until you subscribe.

What counts as a ZETA session: A ZETA session is a single message exchange with ZETA — one message you send, one response you receive. Sessions reset at the start of each billing cycle. Unused sessions do not roll over.

Pro includes: ZETA AI personal intelligence, 68+ verified experts matched to you, workout planner & tracker AI, nutrition scanner AI, habit tracker AI, identity & progression system, Shadow Self mechanics.

Elite includes everything in Pro, plus: 2.5x more ZETA usage, priority response times, exclusive expert access, advanced evolution analytics, direct expert booking priority.

4.3 Founder Pricing (Locked for Life)

If you subscribe before 1 July 2026, your subscription price is locked for life for as long as you maintain a continuous active subscription. After 1 July 2026, standard pricing will apply (£29.99/month for Pro, £49.99/month for Elite).

Founder pricing applies only to your continuous, uninterrupted subscription. If you cancel and resubscribe later, you will be billed at the then-current standard rate.

ENFIITY reserves the right to adjust founder pricing only in the event of substantial increases in operating costs, with at least 60 days' written notice.

4.4 ZETA Top-Ups

If you exhaust your monthly ZETA sessions, you may purchase one-time top-up bundles:

  • 50 sessions — £4.99
  • 150 sessions — £11.99 (most popular)
  • 300 sessions — £19.99 (best value)

Top-up sessions:

  • Are billed as one-time purchases
  • Stack on top of your monthly allocation
  • Do not expire
  • Are non-refundable once credited to your account

4.5 Billing and Payment

All payments are processed by Stripe and billed in British Pounds (GBP). By providing a payment method, you authorise ENFIITY (via Stripe) to charge that method for all subscription fees and purchases you make.

You may purchase ENFIITY through the web (via Stripe), or via Apple App Store or Google Play. In-app purchases through Apple or Google are subject to those platforms' separate terms, billing policies, and refund procedures. For purchases made via Apple or Google, refund and dispute requests must be directed to those platforms.

4.6 Auto-Renewal

Paid subscriptions automatically renew at the end of each billing period (monthly or annual) at the same plan unless cancelled before the renewal date. We will send you a renewal reminder at least 7 days before annual renewals.

4.7 Cancellation

You may cancel your subscription at any time through your Settings page or by emailing team@enfiity.com. Cancellation takes effect at the end of your current billing period — you retain access to paid features until that date.

4.8 Refunds and Cooling-Off Period

Statutory cooling-off period: Under the UK Consumer Contracts Regulations 2013, you have the right to cancel and receive a full refund within 14 days of purchasing a subscription, provided you have not yet started using the paid service.

By starting to use ZETA's paid features (sending messages beyond your free allowance, accessing Pro/Elite-only content), you expressly consent to the immediate provision of digital content and acknowledge that you lose your right to cancel under the cooling-off period.

Outside the cooling-off period:

  • Subscription fees are non-refundable for partial months or unused portions
  • Top-up purchases are non-refundable once credited
  • We do not offer pro-rata refunds for cancellations mid-cycle

Refund requests can be sent to team@enfiity.com within 14 days of any charge you believe was made in error. We review each request individually and may issue a refund at our discretion for billing errors, technical failures that prevented you from using the service, or other genuine grievances.

5Expert Marketplace

5.1 Nature of Expert Relationships

Experts on ENFIITY are independent contractors, not employees or agents of ENFIITY. ENFIITY facilitates connections between users and experts but is not a party to any session, treatment, or service provided by an expert.

5.2 Platform Fees

ENFIITY charges a 20% platform fee on expert session prices, paid by the user at booking. Example: an expert who sets a £100 session price is displayed to users at £120.

5.3 Expert Pricing and Availability

Experts set their own prices, schedules, cancellation policies, and consultation methods independently.

5.4 No Guarantees

ENFIITY does not guarantee the quality, accuracy, safety, or effectiveness of any expert's services, advice, or treatment. Users engage with experts at their own discretion and risk. We strongly recommend you conduct your own due diligence before booking.

5.5 Expert Vetting

Expert applications are reviewed through our ECLIPSE AI system and by human reviewers. While we make reasonable efforts to verify credentials, ENFIITY does not independently verify every claim, certification, or qualification. Users should review expert profiles, qualifications, and reviews carefully.

6Expert Terms

6.1 Truthful Representation

Experts must provide truthful and verifiable qualifications. Misrepresentation is grounds for immediate removal and potential legal action.

6.2 Professional Conduct

Experts must maintain professional conduct at all times, including appropriate boundaries, ethical standards, and adherence to their professional licensing requirements.

6.3 Session Pricing

Experts set their own prices. The 20% platform markup is applied transparently — users see the final price including the platform fee.

6.4 Payment

Payments are processed via Stripe. Experts receive payouts on standard schedules after the platform fee is deducted, subject to Stripe's payout terms.

6.5 Content Licence

By publishing content on the Platform, experts grant ENFIITY a non-exclusive, worldwide, royalty-free, perpetual licence to display, reproduce, and distribute such content for the purposes of operating and marketing the platform. We do not use expert content to train AI models.

6.6 Removal

ENFIITY may remove experts from the platform at any time for policy violations, professional misconduct, sustained negative feedback, prolonged inactivity, or at ENFIITY's sole discretion.

7AI Disclaimer

ZETA is NOT a medical professional, therapist, psychologist, nutritionist, personal trainer, or any other licensed practitioner. ZETA is an artificial intelligence system, and all outputs should be treated as informational suggestions only.

7.1 Informational Purposes Only

All AI recommendations and observations are for general informational and educational purposes only. Nothing ZETA says should be construed as medical advice, clinical guidance, psychological treatment, nutritional prescription, or professional fitness instruction.

7.2 Consult Qualified Professionals

Always consult licensed healthcare professionals, therapists, nutritionists, and trainers for advice specific to your individual circumstances. In medical or mental health emergencies, contact local emergency services immediately (999 in the UK).

7.3 AI Limitations

AI systems can produce inaccurate, incomplete, biased, or misleading information. You are responsible for critically evaluating any information ZETA provides and verifying it independently before acting on it.

7.4 ECLIPSE AI

ECLIPSE assessments of expert applications are automated evaluations supplemented by human review. They are not professional endorsements or certifications.

7.5 No Reliance for Medical Decisions

You agree not to rely on ZETA, ECLIPSE, or any other AI system on the platform for any medical, mental health, legal, or financial decisions. ENFIITY accepts no liability for any harm resulting from reliance on AI outputs.

8Intellectual Property

8.1 ENFIITY Trademarks

ENFIITY, ZETA, ECLIPSE, Shadow Self, Progression Layer, and all associated logos and brand elements are trademarks of ENFIITY Ltd.

8.2 Platform Content

The Platform's source code, design, algorithms, AI prompts, system architecture, and proprietary content are the exclusive property of ENFIITY Ltd or its licensors.

8.3 User-Generated Content

You retain ownership of the content you submit (messages, profile data, goals). By submitting content, you grant ENFIITY a non-exclusive, worldwide, royalty-free licence to use it solely for the purpose of operating and improving the platform for you. We do not use your personal data to train AI models.

9Prohibited Conduct

You agree not to:

9.1 AI Misuse

  • Attempt to generate harmful, illegal, or abusive content through ZETA
  • Manipulate, jailbreak, or attempt to circumvent AI safety measures
  • Use ZETA to impersonate medical, legal, or other licensed professionals

9.2 Fraud and Impersonation

  • Impersonate any person or entity
  • Provide false expert credentials or qualifications
  • Create fake reviews, testimonials, or endorsements
  • Attempt to access another user's account

9.3 Technical Abuse

  • Scrape or use automated tools to extract data from the Platform
  • Reverse engineer the Platform or any of its components
  • Introduce malware, viruses, or harmful code
  • Attempt to bypass rate limits, paywalls, or access controls

9.4 Harassment and Misconduct

  • Harass, threaten, or abuse any user, expert, or team member
  • Engage in discriminatory or hateful conduct of any kind
  • Use the Platform for any unlawful purpose

9.5 Commercial Misuse

  • Resell, sublicense, or commercially exploit the Platform without written permission
  • Use the Platform to develop competing products or services

Violation of these rules may result in immediate account termination without refund.

10Booking and Sessions

10.1 Nature of Bookings

Bookings made through ENFIITY are agreements between the user and the expert. ENFIITY facilitates the booking process but is not a party to the session itself.

10.2 Payment for Sessions

Session payments are processed through Stripe at the time of booking. The total amount includes the expert's price plus the 20% platform fee.

10.3 Cancellation Policies

Each expert may set their own cancellation policy. Review the expert's policy before booking. ENFIITY's role is to facilitate the booking — disputes about session quality, cancellation, or refunds should first be raised directly with the expert.

10.4 Disputes

If you cannot resolve a dispute with an expert directly, contact team@enfiity.com and we will assist where reasonable. ENFIITY's role is mediation, not arbitration.

11Limitation of Liability

11.1 "As Is" Provision

The Platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11.2 No Liability for Expert Services

ENFIITY is not liable for any advice, treatment, outcomes, or harm arising from sessions with experts. Users engage with experts at their own risk.

11.3 No Liability for AI Outputs

ENFIITY is not liable for actions taken based on AI recommendations from ZETA, ECLIPSE, or any other AI system on the Platform.

11.4 Maximum Liability

To the maximum extent permitted by law, ENFIITY's total aggregate liability to you for any claim arising from your use of the Platform shall not exceed the total fees you paid to ENFIITY in the 12 months preceding the claim.

11.5 Statutory Rights

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under UK consumer law. Your statutory rights as a UK consumer are not affected by these Terms.

12Indemnification

You agree to indemnify, defend, and hold harmless ENFIITY Ltd, its directors, employees, and contractors from any claims, losses, damages, or expenses (including reasonable legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Platform

Experts additionally indemnify ENFIITY against any claims arising from services they provide, advice they give, or misrepresentation of their credentials.

13Platform Rights

ENFIITY reserves the right to:

  • Modify, suspend, or discontinue any feature or service at any time, with reasonable notice where practical
  • Modify subscription pricing with at least 30 days' notice (subject to founder pricing protections in Section 4.3)
  • Review, remove, or restrict access to any user-submitted content that violates these Terms
  • Collect and analyse aggregated, anonymised data to improve the Platform
  • Update, retrain, or replace ZETA's underlying AI models without prior notice

14Dispute Resolution

14.1 Governing Law

These Terms shall be governed by the laws of England and Wales.

14.2 Informal Resolution

Before pursuing any formal dispute, you agree to first contact us at team@enfiity.com and attempt to resolve the issue informally. We will negotiate in good faith for at least 30 days before either party may commence formal proceedings.

14.3 Courts

If informal resolution is unsuccessful, the courts of England and Wales shall have exclusive jurisdiction over any dispute arising from these Terms or your use of the Platform.

14.4 Class Action Waiver

To the extent permitted by law, any dispute resolution will be conducted on an individual basis only, not as a class, collective, or representative action.

15Termination

15.1 Termination by You

You may delete your account at any time through your Settings page or by emailing team@enfiity.com. Upon deletion, your personal data will be removed within 30 days, except where retention is required by law.

15.2 Termination by ENFIITY

ENFIITY may suspend or terminate your account immediately for violations of these Terms, fraudulent activity, harmful conduct, or any conduct that endangers other users or the platform.

15.3 Effect of Termination

Upon termination, your right to access the Platform ceases immediately. Provisions that should reasonably survive termination (intellectual property, limitation of liability, indemnification, dispute resolution, governing law) shall survive.

15.4 Refunds Upon Termination

If we terminate your account for a Terms violation, no refund will be issued. If we terminate your account through no fault of your own (e.g. service discontinuation), we will provide a pro-rata refund of any unused subscription period.

16Changes to Terms

ENFIITY reserves the right to modify these Terms at any time. For material changes:

  • We will provide at least 30 days' advance notice via email or in-app notification
  • The "Last updated" date at the top of this page will be revised
  • Continued use of the Platform after the change date constitutes acceptance

If you do not agree to the updated Terms, you may close your account at any time before the changes take effect, in which case you will receive a pro-rata refund of any unused subscription period.
